Demand Rape Charges Be Brought Against the Men Who Raped and Murdered 16-Year-Old African American


Yesterday we reported on the virtual sweeping-under-the-rug of the death of Dione Payne, 16, of Dayton, Ohio. The Dayton Daily News, one of the only local sources to report on the rape, and beating death of the youth seemed more interested in focusing on the “troubled past” of the victim, instead of the past of the murderers.

Michael A. Geldrich, 36, and Michael J. Watson, 39, are both being held in the Warren County Jail for the December 1 beating death of the young Payne. Miami Valley Hospital workers discovered that Payne had been sexually assaulted during the attack. Hospital personnel contacted Middletown police and stated the teen had been sexually assaulted, according to the police report. But thus far, no rape charges have been brought, and hate crime charges have been dismissed point blank by Franklin Police Chief Russ Whitman, who said there is “no evidence” that there was a racial motive to the rape and murder of this 16-year-old African American.

To add insult to injury, some local media reports have fixated on a checkered history of the juvenile: possessing narcotics, and even allegations that he had fired gun shots in the past. They talked about morbid comments made on his Facebook account before the day he was raped and beaten to death. They even called the 16-year-old out for getting arrested for littering. What they did not do was explain why the police have ruled out a racial motive to the attack, and why the Warren County Prosecutor has neither pursued hate crime charges, nor even charged the attackers with rape.

These questions still remain unanswered. But there is more that we can do besides reading about this frustrating account and getting on with our day in silence. What can you do? Well for starters, contact the Warren County Prosecutor, who is now handling the case. Demand that all crimes committed against 16 year old Dione Payne be presented to the grand jury on Michael A. Geldrich and Michael J. Watson- for the hate crime of rape, robbery and murder! The prosecutor can be contacted at the number and email below:

Ask why these criminals have not been charged for raping the 16-year-old boy who they murdered. Also ask why hate crime charges are being excluded, when this does not seem to have been a common practice for these drug buyers to rape and beat-to-death previous people who they have tried to procure narcotics from.

Are these charges being brushed off because there were drugs potentially involved, or for some other reason that neither the police, the City of Franklin nor the local media are reporting.

SPREAD THE WORD and get people involved. Tell everyone you know who thinks this 16-year-old rape and murder victim deserves justice, in spite of his “troubled past”.

        Dear Savannah, with all due respect….the race card is always relevant when the victim can’t speak for themselves. What if it was your kid? Would you not think that the way if your son looked had some role to play in it? From this account, apparently they never chose to rape and murder anybody looked themselves. We have to protect each other. If it wasn’t hatred, why didn’t let him live? And more than that, why did they go beyond robbing him and rape him? If that happened to anybody’s baby, I would question the motivations of the perpetrator as hatred. And in any case, good people don’t do this, so why would anyone care if they’re persecuted to the fullest extent of the law? It’s their lawyers job to represent their character. If 2 black men did this to a white MINOR student, troubled or not, I’d have no problem with the issue of race and hatred being brought up. We can’t be in anyone’s head. But until all life is sacred and we see each other as sisters and brothers, we have to assume they weren’t considering this young man’s full humanity.

    What kind of law allows two large grown men rape, beat, and murder a 16 year old child and do not prosecute for all three charges? Cowards!!! This is what they are. The prosecutor is just as guilty as the cowards that committed this heinous crime.

    Deion Payne 16 years old, who had a long life to live and grow. Here you have these two criminals who are sexual predators, rapist, murderous cowards who prey on children and vulnerable youth and adults.     Shame on the media for focusing on this child’s past. And yes, he was a child who did not deserve to have his life taken so violently. The inaction of law enforcement and the prosecutors is negligent and offensive. Why is so little value placed on Dione’s life? People are forever screaming about their rights – what about Dione’s rights? I have called and emailed, and I’m not done. Dione’s story NEEDS to be heard, and he deserves justice, so I will continue to share this information. This travesty cannot be allowed to quietly disappear.

      it doesnt matter what this kid did. if he smoked weed, littered, shoplifted, swore, drank, used drugs, skipped school, or whatever (just examples). he was RAPED. and it’s as if he asked for it because he was a litterbug. i cant stand when ppl litter, but i hardly think it constitutes deserving to be raped. sad world we live in.

    From the age of 7 until the age of 14 when my mother first open enrolled and then moved us to a more diverse city, I lived and attended school in Franklin, Ohio. I was bullied, spat upon, had beer cans thrown at me, and regularly was called the n-word, not just by kids, but by the adults of this “fine” city. The few friends who stood up for me were called “n—r lovers” and “race traitors”. When I was in the 6th grade, someone had spray painted “nigers” on our back fence. We heard from other kids exactly who had done it – these “grown” “men” bragged about it to anyone who listened, but the police did nothing and when we took it to court, the court found them guilty with no solid proof or witnesses.

    My brother was regularly jumped at his high school. My sister was sexually assaulted at her elementary school by a boy who wanted to see what color her nipples were. In all cases, we were the ones who were punished as our assailants had the rest of the white student body backing them up and those who didn’t stood by silently.

    When I heard about this boy being lured to Franklin and murdered the very first thing on my mind was that the men who did it would look like skinheads, probably drove pick up trucks, and probably had Confederate flags somewhere on their bodies, their trucks, and/or their homes. My mother and grandmother grew up in Franklin during the 1940’s through the 1970s, but the whole place was taken over by trash during the 80s and continues to be a haven for racist scum, many of whom have no fear of repercussion for their hate because of the police force (like many of the staff in the school system) not only condone it, but support it.

    So I am absolutely unsurprised the police are covering this up, that they are trying to squirm out of pressing any charges (as I have been witness to them doing), and are pretending that race was not a motive for this boy’s death. The only thing that is a surprise is that this story managed to leak out of Franklin, but I think that was only because the boy was from Dayton… notice it was only the Dayton Daily News who broke the story. Not a peep from the Franklin Chronicle.

What if it would have been a little white boy and 2 grown black men who assaulted him????? The thought of this happening to anyone is horrific but the fact it happened to a child really breaks my heart. I don’t care what race anyone was color means nothing to me. . The commenter above you made the point that this story would be receiving a lot more press if the races of the victim and perpetrators were switched. This is hardly an inflammatory statement; it’s simply the unfortunate truth.

        Regarding the crime itself, it’s possible that these two men killed Dione Payne because he was African-American, and it’s possible that race had nothing to do with it. You don’t know, so why are you insisting that we not talk about all the possibilities?

        “The race card” is not a thing, and you cannot shame people for discussing race when it is relevant. I’d ask you to take your own advice and “just stop.”

        How do you know that race is “IRRELEVANT” in this case? The only people that can say this is the people that did this horrible crime. They are the only ones that know what their intentions were.

        Regardless of whether or not you’re comfortable with it. Race is very much a factor in this. I have several friends from Dayton, Ohio and they are quite behind as far as race relations are concerned.

    Regardless of this child’s past or whatever he was into, he was still a child. He was a baby. Not even old enough to even experience life. The police in Franklin Ohio are definatly racist. I would bet money that if this were a 16 year old white girl or boy from Franklin they would try to get the book thrown at him. The police are lazy and they are racist cowards. I should know I’m from Franklin Ohio. Thank the lord I’m not there now. I will do my part and email the prosecuter. I will sign any petition. Everybody should do something. Do what you would want others to do if this were your child. My prayers are with the family.

      Riatta like I said I grew up in Franklin and yes its a racist town. I’ve been called n lover a lot. My ex boyfriend broke into my apartment when I was 18 and him and his cousin jumped my new boyfriend at the time who was a black guy. The police did nothing and even laughed with my ex calling me a n lover. So when I heard this it made my stomach turn. That whole town is trash. So glad I’m away from there. This young boy deserves justice!!

    I believe the world needs to take a stand on these type of crimes. I think that all states should prosecute and treat all rape crimes as murder. Its happening to often and people know if they do it they will get a way with it. These are sick individuals and they need to go under garish punishment. How can u take the life of someone ? Or forcefully have unwanted sex ? In my eyes they deserve to be 10 feet under. Electric chair maybe!!! This breaks my heart.     I realize that they’ve charged these men with the highest charge possible and that they could get the death penalty as a result. However, if this boy was indeed raped, leaving that charge out is denying him and his family justice for something that might have been worse than death in his mind. It also sends a message to other victims that might have been raped & left alive that the crime against them isn’t important if they lived. On a second note, it really doesn’t matter if this 16-year-old child was a dope dealer, that was a matter for the law & for all we know he could’ve had an intervention and grown up to find a cure for cancer. In any event, his misdeeds doesn’t give anyone the right to beat, rape, steal from him, and leave him to die.

    Even if this CHILD did have juvenile brushes with the law, does that mean his rights are voided. If that’s the case then why are the criminals, in prison, always protected by the law even after being found guilty BY THE LAW.     The youth’s parents or loved ones should press for the rape and hate crime murder to the local FBI and federal Attorney General. Those reprobate homosexuals should suffer death for their inhumanity to that child.     Young Black men are raped daily by other Black and Brown men in our juvy and adult prison system and nobody says a word about it. But let a white person do something to one of us and a nation of Black folks suddenly get organized. For the most part it isn’t cops or white people, its drugs and gangs and most of the people profiting from our victimization don’t even live in this country. Black Lives Matter alright, and it’s time we started to tell the truth about who’s killing us.
