Police Stand By Arrest Of Innocent Man With 0.0 Breathalizer Results


Larry Davis was arrested last January when police say he ran a stop sign. According to the arresting officers in Texas, Davis was “drunk.” The only problem is that Davis says he wasn’t and volunteered to take a field sobriety test. The “Breathalizer” test results said that Davis had a 0.0 result, demonstrating that he was as far from drunk as possible, according to the test.

Now police are standing by their drunken driving arrest of Davis, even though his Breathalizer and addition blood tests showed he was not intoxicated.

Since the blood test results have come in, Davis has requested that his name – and record – be cleared.  Still, the arresting officer’s supervisor said he supports the decision to arrest Davis, in spite of the clear evidence that he had done nothing arrest-worthy wrong.

Neverthless, Cmdr. David Mahoney, of Austin police said that, “If there is someone who is possibly impaired, we don’t want them driving. We need to get them off the road, so that was probably (the officer’s) mindset.”

Davis, on the other hand, said “I was arrested for nothing, really. It was suspicion of drunk driving, which I wasn’t so I was surprised and hurt at the same time.”
